In the aim of security it appears as if government is trampling on our 4th Ammendment right against unreasonable searches and seizures. This Ammendment is one of the keys that keep us a free people. We have seen throughout history that many totalitarean regimes use security as an excuse to limit freedom. Yet we must realize the enemy we face today does not fight along normal military conduct but seeps through the very foundation of our freedoms. This is why we must insure that the government has the right to protect us without protecting it’s control. Here are a few ways we can keep control.
(1) Government can’t hold records on any American Citizen without approval by the judicial branch or by that individual. The judicial branch could only approve such records if there was clear and sufficient evidence that this individual poses a threat to himself or others around him.
(2) Government must get judicial approval every 6 months to continue to keep the records on such individuals and that this approval must be based on the continual threat that these individuals pose to themselves or others. Annually the government must reach out to a different judicial authorities to continue to keep such records on private citizens.
(3) Government is not permitted to data search records on American Citizens that have not shown any proclivity to acts of violence against themselves or others.
